On behalf of the Town of Gorham (Town), Northland Enterprises LLC (NLE) is issuing this request for bids (RFB) for the construction of the public roadway and associated infrastructure entering the new Gorham Industrial Park - West Campus. NLE is serving as a consultant to the Town during the bid period and contractor selection process for this RFB.

Sealed Bids addressed to Town of Gorham and endorsed on the wrapper “Bids for Gorham Industrial Park Road & Infrastructure Construction in the Town of Gorham” will be received from contractors at the Gorham Municipal Center, located at 75 South Street, Suite 1, Conference Room A, Gorham, Maine 04038, at 2pm EST on July 20, 2023, and publicly opened and read.

Town will consider all relevant materials and information in making its selection. The Town will select the bidder that it determines, in its sole discretion, is best able to perform the work specified in this RFB and is the lowest responsive, responsible Proposer. Please note that the lowest responsive bidder must demonstrate to the Town that it is qualified to undertake the work to be considered for the award of this contract. Current pre-qualification by the Maine Department of Transportation in AT LEAST the Highway (H) category may fulfill this requirement, however contractors approved in other categories may be considered if they can demonstrate successful work on similar projects to the scope of this bid.
 
Project Description
The Town has purchased two (2) adjacent parcels of open land for the purpose of utilizing both parcels for commercial/industrial use. The Town has subdivided one parcel, Map 29 Lot 1, to create five (5) lots ranging in size from 3.4 acres to 15.5 acres (one lot is to remain Open Space). FY22 Community Project Funding will be used to fund a portion of road construction (approximately 2,575 linear feet) to service individual commercial/industrial lots.
 
In November 2019, a voter referendum was approved by Gorham residents for a $5.9 million bond to fund the purchase, design and construction of land adjacent to the Gorham Industrial Park for additional commercial industrial use. A total of $4 million of the bond was used for the purchase of the land, consisting of two large land parcels. The remaining $1.9 million in bond funds are designated for design and development of the two land parcels. Community Project Funding/Congressionally Directed Spending are to be used with remaining bond funds and other federal funding to design and build a new road to service a new commercial subdivision established as part of the Gorham Industrial Park – West Campus (GIP West) project.
 
The maximum anticipated scope of the project proposal represents Phase 1 of the GIP West project. The Gorham Industrial Park - West Campus consists of two adjacent parcels of land zoned for industrial use. Phase 1 of development focuses on the southern parcel (Map 29 Lot 1, a 49.9-acre undeveloped site with no existing facilities associated with it. Prior to subdividing the parcel the Town split off a 7 acre parcel in the North West corner, which can be fully serviced by existing infrastructure along Libby Ave. Therefore, a total of four (4) commercial lots would be serviced by the new road, approximately 2,575 linear feet in length, to be constructed between Cyr Drive and the Crosstown Trail. The scope of this bid is to fully construct the public infrastructure required for Phase I of GIP West Campus, to include the roadway, culvert stream crossing, stormwater features, water, sewer, gas, electric and communications to service the commercial lots, in accordance with the plans, specifications and permits.
 
SLR Consulting has served as civil engineer of record for the submission of the Town’s application for Site Location of Development (SLODA) and Natural Resource Protection Act (NRPA) approvals by the Maine Department of Environmental Protection (DEP) and associated Army Corps of Engineers (ACOE) approvals. Final subdivision approval was obtained in February 2023 from the Planning Board, thus allowing road construction and individual lot construction to begin. The Town will utilize a pool of various funding sources, including Community Project Funding to cover the full cost of the project.
 
Pre-Bid Meeting

A pre-bid meeting is not currently scheduled or anticipated but, if requested by bidders, NLE and Town officials will schedule an on-site meeting prior to bids being due. Requests for Information
All Requests for Information (RFI’s) should be transmitted electronically in e-mail form only to Brad Fries (brad@northlandus.com) and Mike Zarba (mzarba@slrconsulting.com). Formal responses to all contractor RFI’s will be available to all bidders no later than three (3) business days prior to bids due. The deadline for submitting RFI’s to NLE and SLR will be July 10, 2023 by 2pm.

Projected Timeline
Bid award is expected in August with contract execution anticipated by late summer 2023. Projected construction commencement is expected fall 2023 with all items to be completed by fall 2024.
 
Construction Contract (EJCDC Document)
The construction contract will be based on the EJCDC Document C-520, Agreement Between Owner and Contractor for Construction Contract (Stipulated Price), to be executed directly between Contractor and the Town of Gorham. Any exceptions to the same shall be noted in the proposal.
 
Contractor Proposal and Estimate
Please provide the following line items broken out separately in your estimate:
  1. Overhead and profit (fee) percentage to be charged.
  2. Lump sum general conditions amount.
  3. A full estimate schedule of values (see attached Bid Schedule and Special Provisions).
  4. An estimate of construction time (in days).
  5. The name and resume of the individual contractor proposes to use as Superintendent of Field Foreman for the entire duration of this project.
  6. The name and resume of the individual contractor proposes to use as Project Manager for the entire duration of this project.
Bonding

Each Bid must be made upon blank forms provided by the Municipality and must be accompanied by a bid bond of 5% of the bid amount or an official bank check, cashier’s check, certified check, certificate of deposit, or United States postal money order for 5% of the bid amount, payable to Town of Gorham, as a Bid Guaranty.

Performance and Payment Bonds for 100% of the contract value will be required. As part of your response, please confirm your bonding capacity for the project.

Based upon a review of all the above-mentioned information contractors will be selected for an interview with NLE and the Town.

Reservation of Rights
The Town reserves the right to request clarification of and/or solicit additional information of any bidder, to have bidders make presentations to the Town; and/or to negotiate with any bidder regarding any terms of their proposal, including but not limited to the cost and/or scope of services, with the intent to achieve a contract that is deemed by the Town to be in its best interest. The Town reserves the right to waive any informalities in bid proposals, to accept any bid or po tions thereof, and to reject any and all bids, should it be deemed in the best interest of the Town to do so. The Town reserves the right to substantiate a bidder’s qualifications, capability to perform, availability, past performance record and to verify that the bidder is current in its obligations to the Town.
 
Pursuant to Town procurement policy and ordinance, the Town is unable to contract with businesses or individuals who are delinquent in their financial obligations to the Town. These obligations may include but are not limited to real estate and personal property taxes and sewer user fees. Bidders who are delinquent in their financial obligations to the Town must do one of the following: bring the obligation current, negotiate a payment plan with the Town Treasury
office, or agree to an offset which shall be established by the contract which shall be issued to the successful bidder.
 
Proposal Terms Firm and Irrevocable
The signed bid shall be considered a firm offer on the part of the bidder. All bid responses (including all statements, claims, declarations, prices and specifications in the Proposals) shall be considered firm and irrevocable for purposes of contract negotiations unless specifically waived in writing by the Town. The successful bidder should be prepared to have its bid and any relevant correspondence or documentation incorporated into the Construction Contract, either in part or in its entirety, at the Town’s election. Any false or misleading statements found in the bid may be grounds for disqualification.
 
Each bid shall contain a statement to the effect that the bid is a firm offer for a sixty (60) calendar day period from the date of the bid opening. This statement must be signed by an individual authorized to bind the bidder and include such individual’s name, title, address, and telephone number.
